Miami Family Law Attorneys:
Paternity Status Quo Order

If you have filed an action regarding the establishment of paternity, the courts also have a status quo order that directly affects how the matter will proceed by locking down all the factors related to paternity that are in effect until they are modified by the court, or the matter is finalized.

Relocation

The mother is required not to relocate until the matter is resolved, and if the father whose paternity is ultimately proven relocates, it could affect their visitation schedule.

Payment of Child Support

If the presumed father is already paying child support, he should continue to do so until the matter is resolved. If he is ultimately proven not to be the father, the matter will be addressed at that time.

Time-Sharing

If the presumed father already has some time-sharing established with the child, this visitation schedule should be maintained. If not, however, a schedule should not be implemented until the matter is resolved.
